This work is in the public domain because it was published in the United States between 1929 and 1963, and although there may or may not have been a copyright notice, the copyright was not renewed. There's only three works which could possibly have the photo: Kidnapped Kidnapped No. 378, No. 1600 and No. 1101. No. 378 and 1600 have just drawings. No. 1101 does have photos, (see [1]), but this one does not appear to be included. There is a little bit of doubt, but I don't think it's significant enough for COM:PCP.
